Personal Data and Privacy Notice

When you visit our website, you are not required to provide any personal data on the public areas of our website. However, you may choose to provide us with information by contacting us, including subscription to our publications and client alerts, or career enquiries and applications.
This Personal Data and Privacy Notice is issued pursuant to the Malaysia Personal Data Protection Act 2010 (“Act”) (“Privacy Notice”), and explains the type of data we collect or have collected and how we collect the data, the purposes of processing such data, the parties we disclose or have disclosed the data to and the choices available to you including how to access and correct such personal data.

 

Collection of Personal Data

In your course of dealings with us, we will request that you provide data and information about yourself, your organisation, your employees and/or your customers (“Personal Data”) to enable us to deliver the necessary services, deliverables and/or marketing in connection with our business.
Such Personal Data may include information concerning name as per identity card, preferred name, identity card number, age, contact number, residential address, email address, birth date, gender, occupation, designation, bank account details, financial and legal standings, tax information, solvency, information of spouse/ children such as name and birth date, information as to physical or mental health, religious beliefs, the commission or alleged commission of an offence and other such data necessary for the performance of our services to you.
We may obtain such Personal Data from yourself and/or from a variety of sources, including but not limited to:

1. information or comments you have provided to us by whatsoever means and/or in whatsoever manner;
2. information obtained independently by us or given to us from other lawful sources; 
3. cause papers, notices, letters, search reports, contracts, agreements, forms and other documents provided to us either by you and/or other law firms or lawyers and/or other parties or persons and/or which we have access thereto; and/or
4. subject to your prior consent, from third parties connected with you, such as employers, employees, assistants, family members, friends, and security providers.

Personal Data may also be provided by someone on your behalf, in which case, we will assume until notified otherwise, that you have authorised the disclosure of your Personal Data to us.

 

Processing and Utilising of Personal Data

Other than as stated above, Personal Data you provide will be collected, used and otherwise processed by us for, amongst others, the following purposes:

1. provide you with services incidental or in relation to that you have engaged us for;
2. implementation and performance of any legal services, advice and obligations that we may render to you or third parties;
3. conduct credit assessments, financial and background investigations as and when deemed necessary;
4. conduct anti-money laundering checks and/or to comply with any sanction requirements;

11. meeting any legal or regulatory requirement relating to our services and to make disclosure  under the requirements of any applicable law, regulation, directive, guideline, by-law, code, circular, government authorities and/or court of competent jurisdiction; and/or
12. all other purposes necessary and/or incidental to our business and all purposes necessary for or related to any of the above purposes.

We will request for your consent before using your Personal Data for purposes other than those that are set out in this Privacy Notice and in the privacy terms in your agreement(s) with us.

 

Consequences of Non-Provision of Personal Data

Where indicated, it is obligatory to provide your Personal Data to us to enable us to process your application for our products or services. Should you decline to provide such obligatory Personal Data, we may not be able to provide you with our services.

 

Disclosure of Personal Data

Personal Data provided to us will generally be kept confidential. However, you are deemed to have given us consent to provide access to or disclose your Personal Data to the following parties: 

1. any person to whom we are compelled or required to do so under law or in response to a competent regulatory or government agency;

We treat all Personal Data provided to us as confidential and will endeavour to preserve the confidentiality and security of your Personal Data stored with us in accordance with applicable laws and regulations to prevent unauthorized or unlawful processing thereof.

We will retain your personal information in compliance with this Privacy Notice and/or the terms and conditions of your agreement(s) with us throughout the duration of your engagement with us, or for such period as may be necessary in compliance with our internal policies or otherwise as required by law.

 

Rights to Access and Correct Personal Data

You have the right of access to your Personal Data upon payment of a prescribed fee and you may request that we correct any of your Personal Data which is inaccurate, incomplete or out of date. You may also withdraw your consent or restrict the purposes and methods in which we process your Personal Data.
